ODEQ Cannot See Fugitive Dust Leaving Propery Line

On April 17, 2009, Eddie Terrill of the DEQ stated in an email, “In order for us to determine whether our fugitive dust rules would apply we need to either see the material leaving the property line or verify that fugitive dust is impacting property beyond the property line from which it was generated. Fly ash is so fine that the likelihood of us actually seeing it leave the property is almost zero.” After seeing the video and photographic evidence, you have to wonder how it is possible to miss seeing it.

In January 2009 Bridget Kenyon Wood took the video on the home page. It shows the fugitive dust being release off site at Making Money Having Fun LLC. In May 2009, as a result of residents attending the April ODEQ Air Quality Meeting, the ODEQ investigated M.M.H.F., LLC. They found numerous violations, They wrote a memo concluding that Making Money Having Fun has been operating illegally without a permit from the ODEQ for 7 years.

As of today, it is still in operation. Although changes have been made in the way the fly is dumped, there are still serious issues with the fugitive dust. The videos below were done by Tim Tanksley. The top was filmed in Oct. 2009 and the bottom in Jan. 2010. If you and I can see the fugitive dust leaving the property line, why is it that the DEQ cannot see it? Why is it they refuse to act on the violations?
